Terms of service
Version 2.0 · In effect from 14 October 2026 for new accounts, and from 14 November 2026 for accounts created before 14 October 2026. Replaced by version 2.1 on 15 October 2026 for new accounts, and on 14 November 2026 for accounts created before 14 October 2026 · Previous version
This is an earlier version, kept for reference. The current version of the terms is at hypamoon.com/terms.
These are the terms for using Hypamoon during early access: the portal at app.hypamoon.com, the API at api.hypamoon.com, the MCP server, and the sites, apps, data, phone, payments and other services we run for your project. They are short on purpose. If something is unclear, email hello@hypamoon.com and we will explain.
1. Who we are
Hypamoon is a service of Hypamoon B.V. (“we”, “us”). We are the seller of the Hypamoon service: you buy plans, balance, numbers and usage from us. These terms apply between us and whoever creates an account (“you”).
Hypamoon is built for businesses, and individuals can use it too. If you sign up for a business, you accept these terms on behalf of that business. If you use Hypamoon as a consumer, that is as an individual for purposes outside your trade or profession, the consumer rules of the country where you live still apply where they give you more rights than these terms.

2. Early access
Hypamoon is in early access. The service is still being built, and that has consequences you should know about:
- Features, endpoints, limits and the MCP tools can change, be added or be removed. We announce breaking changes in the docs at hypamoon.com/docs and, where it affects your live project, by email.
- Some things are not available yet. Outbound calls, for example, only open up after full verification.
- We may limit or end early access for everyone or for a single project. If we end it for everyone, we tell you at least a month in advance, unless misuse or the law forces us to act sooner.
3. Account, projects and keys
- Each project has a test project next to it. Test keys (
hm_test_) only reach simulated calls and test numbers. Nothing in test mode is charged and no real call is made. - Live keys (
hm_live_) reach the real phone network and cost money. Treat them like a password: keep them out of client side code, public repositories and logs, and revoke a key in the portal as soon as you suspect it has leaked. - You are responsible for everything that happens with your keys, with the apps you connect through OAuth (such as Claude, ChatGPT or Grok) and with the agents you let act for you. What an agent does with your project counts as something you did. You can revoke a connection at any time in the portal.
- You can protect your account with a second step: an authenticator app or a passkey. We may ask for that second step before a sensitive action, such as a payment or a new key, and an owner can require it for everyone in the team.
- Keep the details in your account correct, including the email address we use for notices and the address and country we invoice.
4. Verification
Whoever calls through Hypamoon calls on our account with our telephony supplier, and phone numbers come with rules that differ per country and type of number. Where the number requires it, for example a Dutch 085 number, we ask you to verify your business. That is why live use goes in steps: company verification for live keys and inbound calls, number documents for regional numbers, and full verification (identity of the director or authorised person, the ultimate beneficial owners and a review by us) for outbound calls and a spending cap above 500 euros per month.
We may refuse a verification step without stating every reason. We may also withdraw a step later, for example when information turns out to be incorrect or we see signs of misuse. Live keys and connections that depend on that step then stop working.
5. Acceptable use
You use Hypamoon only for lawful purposes. In particular, you do not use it for:
- spam, unsolicited bulk calls or texts, or automated calls (robocalls) to people who did not agree to them;
- fraud, phishing, impersonation or misleading people about who is calling or why;
- call fraud, such as generating traffic to premium rate numbers or to numbers abroad for profit;
- getting around the destination checks, spending caps, rate limits, country rules or verification, or helping someone else do so;
- anything that infringes the rights of others or disrupts the service or the phone network.
You comply with the rules that apply to your calls, including the telemarketing rules of the Dutch Telecommunications Act (consent for unsolicited calls to consumers), the Bel-me-niet Register and the GDPR. You are responsible for having consent or another legal basis for the people you call or who call you, and for telling them what they need to know: that a call is recorded, and that they are talking to an AI. Our assistants say at the start of a call that they are a digital assistant; you do not switch that off or work around it.
Hypamoon is not a replacement for a regular phone line for emergencies. Calls to emergency numbers such as 112 are not supported.
If we see misuse, or have good reason to suspect it, we may block calls, pause a project, revoke keys and connections or close the account, without notice if the situation calls for it. Costs caused by misuse of your project are yours.
To report misuse by someone else, email abuse@hypamoon.com or use the report form. How we handle reports explains what we do, how fast, and how an owner can object to a decision.
6. Phone numbers
Dutch numbers are assigned by the Dutch regulator and provided to us through our telephony supplier. You get the right to use a number for as long as your project uses it; you do not become its owner. The rules of the Dutch numbering plan apply, including the registration of the business and address that use a number. We may have to withdraw or change a number if the regulator or the supplier requires it. If you want to take a number to another provider, we cooperate where the rules allow it. A number you release or that ends with your project may be given to someone else after a period.
7. Plans, costs and spending cap
- The prices that apply are on our pricing page and in the portal before you incur them. For businesses, amounts exclude VAT unless stated otherwise. Individuals see what they pay including VAT.
- A paid plan is paid in advance for each period (a month or a year) through a payment mandate, by card or direct debit, that you set up in the portal. It renews automatically. A higher plan starts right away, and you pay the difference for the rest of the period. A lower plan, or cancelling, takes effect at the end of the period; we do not refund the current period, and your plan keeps working until it ends.
- Usage that is not included in your plan is paid from your prepaid balance, as described in article 8.
- Every live project has a spending cap per month that you set yourself: at least 10 euros, and above 500 euros only after full verification. When the cap is reached, actions that cost money stop until the next month or until you raise the cap. The cap is a safety rail, not a guarantee: usage that is already under way, such as a call in progress, can take you slightly over it.
- Every payment comes with an invoice, which we email and which is also available in the portal.
- If a payment fails, we try again and let you know by email. If a payment stays open, we may pause actions that cost money, such as outbound calls, ordering numbers and voice AI, until it is paid. As soon as it is paid, we open everything up again.
- We may change prices. We tell you at least a month in advance by email; if you do not agree, you can stop before the new price applies.
8. Prepaid balance
You pay for usage in advance by topping up your balance in the portal. You can also let your balance top up automatically with a saved card when it drops below an amount you choose; you can switch that off at any time. We invoice each top-up, with VAT, when you pay it.
Each top-up is valid for 12 months from the date of purchase. Usage is deducted from your oldest top-up first. Any amount of a top-up that is unused 12 months after its purchase expires and is removed from your balance; we email the account owner 30 days and 7 days before that date. The monthly allowance included in a plan, such as AI credit, is valid for the period it belongs to and does not carry over.
Your balance is for Hypamoon only. You can use it to pay for our services and for nothing else. It cannot be transferred to another account or person, exchanged for cash or paid out, and it earns no interest. If an agency or another account pays for your project, usage is deducted from the balance of the account that pays.
We only refund balance that is unused: when you withdraw from a top-up as described in article 11, when we charged you by mistake, or when we end the service or your access for a reason that is not caused by you. A refund goes back to the payment method you paid with, and you receive a credit note for it. If your bank or card issuer reverses a payment, we remove that amount from your balance.
9. Amounts held for calls and runs
When a call with the AI assistant, an outbound call or an agent run starts, we hold an estimated amount on your balance. When it ends, we charge the actual cost and release the rest. A hold that is not settled is released automatically. Held amounts count towards your monthly spending cap. If your available balance is too low for the hold, the call or run does not start.
10. Where you are
Individuals can use paid plans and top-ups in the Netherlands. Businesses can use them in the Netherlands, the European Union and the United States, and in other countries with a verified business registration, except in countries and regions under broad EU or US sanctions. Hypamoon is not available at all in countries and regions under broad sanctions.
To determine where you are we use your billing address, the country of your payment method and the country of your IP address; if these differ, the most restrictive applies. Phone numbers, calls and SMS are available in the countries we offer in the portal when you order a number (today: the Netherlands).
If the information about where you are turns out to be incorrect, we may stop paid use until it is corrected.
11. Right of withdrawal (individuals in the EU)
If you are a consumer in the European Union, you can withdraw from a top-up within 14 days of purchase without giving a reason. If you asked us to start right away and have used part of the balance, we refund the unused part. After 14 days, or for balance that has been fully used, the right of withdrawal no longer applies.
You can only use balance once we have started. That is why we ask you at your first top-up whether we should start right away; your answer also applies to your later top-ups, including automatic ones.
To withdraw, email hello@hypamoon.com from the email address of your account, or send us the model form below. You do not have to use the form. We refund within 14 days of receiving your message, to the payment method you paid with, and you receive a credit note.

12. Selling through Hypamoon
With Hypamoon you can take payments from your own customers: a store, a checkout on your site, paid access to your tool or gift cards. For those sales you are the seller, and we are only the platform.
- The contract of sale is between you and your customer. We are not a party to it.
- Payments go to your own account with a payment provider that you connect. The money does not pass through Hypamoon.
- We charge a platform fee per payment. You see the fee and agree to it when you connect payments, and it is taken from each payment. A different fee only applies after you agree to it again.
- You are responsible for your prices and for the VAT on your sales (charging, invoicing, reporting and paying it), for your own terms and privacy statement, for the information your customers must get, for their right of withdrawal, and for delivery, refunds, disputes and chargebacks. You also make sure that what you sell is allowed.
- We give you tools that help, such as VAT calculation, invoices and credit notes in your name with their own numbering, and a confirmation email with your details, your terms and the model withdrawal form. These are aids. Check that they fit your business: using them does not move your responsibility to us.
- For the personal data of your customers, you are the controller and we are your processor, as described in article 13.
13. Data and processing
For the personal data of the people you serve through your project (your callers, the visitors and users of your sites and apps, your customers and their orders, and what your assistant hears, including numbers, recordings, transcripts and summaries), you are the controller and we are your processor. We only process that data to provide the service, on your instructions: these terms, the settings you choose in the portal and through the API, and what you ask us in writing. For the data we need to have you as a customer (account, users, verification, balance, invoices and payments), we are the controller ourselves.
Data you send to your own webhook endpoints or to apps you connect leaves our service at your request; from there it is your responsibility. Verify webhook signatures and keep your endpoints secure.
We use specialised suppliers for telephony, speech recognition, voices, the language model, payments, hosting and storage. A data processing agreement is available on request at hello@hypamoon.com. Our privacy statement explains what we process and for how long.
14. Availability
We do our best to keep Hypamoon running well and securely. During early access we give no guarantee of availability, response times or a particular result. Telephony depends partly on networks and suppliers we do not control, and AI can make mistakes: check what your assistant does before you rely on it.
15. Liability
Our liability for damage is limited as far as the law allows. We are not liable for indirect or consequential damage, such as lost revenue or missed calls, for outages in networks of third parties, or for what your code, your agents or the apps you connect do with the API. Nothing in test mode leads to liability on our side. You indemnify us against claims of third parties that arise from your use of Hypamoon in breach of these terms or the law, including claims of your own customers about what you sold them.
16. Ending
There is no minimum term. You can delete a project or close your account in the portal at any time, or email hello@hypamoon.com and we do it for you. Usage up to that moment can still appear on a final invoice. Use your balance before you close your account: unused balance is only refunded in the cases in article 8. We may end your access as described under acceptable use and early access. After the end we delete the data of your project in line with our retention periods, unless the law requires us to keep it longer.
17. Changes to these terms
We may change these terms, which is likely while Hypamoon is in early access. We announce changes that matter for you at least a month in advance by email. If you keep using the service after that, the new terms apply; if you do not agree, you can stop before they take effect. Each version carries a number and a date, and earlier versions stay available, such as the version of 2 October 2026.
18. Applicable law
Dutch law applies to these terms and the service. Disputes are submitted to the competent court in the Netherlands. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you can also go to the court there.
