Hypamoon

Terms of service

Version 1.0 · In effect from 2 October 2026. Replaced by version 2.0 on 14 October 2026 for new accounts, and on 14 November 2026 for accounts created before 14 October 2026.

This is an earlier version, kept for reference. The current version of the terms is at hypamoon.com/terms.

These are the terms for using Hypamoon during early access: the portal at app.hypamoon.com, the API at api.hypamoon.com and the MCP server. They are short on purpose. If something is unclear, email hello@hypamoon.com and we will explain.

1. Who we are

Hypamoon is a service of Hypamoon B.V. (“we”, “us”). These terms apply between us and the business that creates an account (“you”). Hypamoon is built for businesses; you accept these terms on behalf of the business you sign up for.

2. Early access

Hypamoon is in early access. The service is still being built, and that has consequences you should know about:

3. Account, projects and keys

4. Verification

Whoever calls through Hypamoon calls on our account with our telephony supplier, and Dutch numbers can only be registered to a verified business. That is why live use goes in steps: company verification for live keys and inbound calls, number documents for regional numbers, and full verification (identity of the director or authorised person, the ultimate beneficial owners and a review by us) for outbound calls and a spending cap above 500 euros per month.

We may refuse a verification step without stating every reason. We may also withdraw a step later, for example when information turns out to be incorrect or we see signs of misuse. Live keys and connections that depend on that step then stop working.

5. Acceptable use

You use Hypamoon only for lawful purposes. In particular, you do not use it for:

You comply with the rules that apply to your calls, including the telemarketing rules of the Dutch Telecommunications Act (consent for unsolicited calls to consumers), the Bel-me-niet Register and the GDPR. You are responsible for having consent or another legal basis for the people you call or who call you, and for telling them what they need to know: that a call is recorded, and that they are talking to an AI. Our assistants say at the start of a call that they are a digital assistant; you do not switch that off or work around it.

Hypamoon is not a replacement for a regular phone line for emergencies. Calls to emergency numbers such as 112 are not supported.

If we see misuse, or have good reason to suspect it, we may block calls, pause a project, revoke keys and connections or close the account, without notice if the situation calls for it. Costs caused by misuse of your project are yours.

To report misuse by someone else, email abuse@hypamoon.com or use the report form. How we handle reports explains what we do, how fast, and how an owner can object to a decision.

6. Phone numbers

Dutch numbers are assigned by the Dutch regulator and provided to us through our telephony supplier. You get the right to use a number for as long as your project uses it; you do not become its owner. The rules of the Dutch numbering plan apply, including the registration of the business and address that use a number. We may have to withdraw or change a number if the regulator or the supplier requires it. If you want to take a number to another provider, we cooperate where the rules allow it. A number you release or that ends with your project may be given to someone else after a period.

7. Costs, spending cap and payment

8. Data and processing

For the personal data in your calls (callers, numbers, recordings, transcripts, summaries and what your assistant hears), you are the controller and we are your processor. We only process that data to provide the service, on your instructions: these terms, the settings you choose in the portal and through the API, and what you ask us in writing. For the data we need to have you as a customer (account, users, invoices, payments), we are the controller ourselves.

Data you send to your own webhook endpoints or to apps you connect leaves our service at your request; from there it is your responsibility. Verify webhook signatures and keep your endpoints secure.

We use specialised suppliers for telephony, speech recognition, voices, the language model, hosting and storage. A data processing agreement is available on request at hello@hypamoon.com. Read our privacy statement for how we handle the data you leave on hypamoon.com.

9. Availability

We do our best to keep Hypamoon running well and securely. During early access we give no guarantee of availability, response times or a particular result. Telephony depends partly on networks and suppliers we do not control, and AI can make mistakes: check what your assistant does before you rely on it.

10. Liability

Our liability for damage is limited as far as the law allows. We are not liable for indirect or consequential damage, such as lost revenue or missed calls, for outages in networks of third parties, or for what your code, your agents or the apps you connect do with the API. Nothing in test mode leads to liability on our side. You indemnify us against claims of third parties that arise from your use of Hypamoon in breach of these terms or the law.

11. Ending

There is no minimum term. You can delete a project or close your account in the portal at any time, or email hello@hypamoon.com and we do it for you. Usage up to that moment can still appear on a final invoice. We may end your access as described under acceptable use and early access. After the end we delete the data of your project in line with our retention periods, unless the law requires us to keep it longer.

12. Changes to these terms

We may change these terms, which is likely while Hypamoon is in early access. We announce changes that matter for you at least a month in advance by email. If you keep using the service after that, the new terms apply; if you do not agree, you can stop before they take effect.

13. Applicable law

Dutch law applies to these terms and the service. Disputes are submitted to the competent court in the Netherlands. If the Dutch and English versions differ, the English version prevails.
